At 20:30 on Monday 23rd March 2020 the UK Prime Minster announced further measures to help reduce spread of Coronavirus COVID-19. The country has in essence been placed into ‘lockdown’, and during the announcement Boris Johnson told the nation to only leave home for the following:
  1.  Shopping for basic necessities, as infrequent as possible.
  2. One form of exercise a day (social distancing rules apply) – alone or with members of your household.
  3. Any medical need / care for vulnerable person(s)
  4. Travelling to and from work, only if absolutely necessary and can not be done from home.
The above should be the only reasons why you should leave your home. Alongside these rules, the government have announced that all shops who are not deemed as selling essential goods will close, including clothing, electronics, libraries etc. Places of worship, weddings and baptisms will also be stopped and funerals will only go ahead for immediate family. If people do not follow the rules, the police has the power to impose fines or disperse people. What does this mean for my business? By now, most businesses are either closing or working from home. Unless you are deemed as a key employer or an essential business, you should be preparing for this, if you haven’t already. Many organisations are able to work from home whereas some businesses simply can’t. Businesses are looking at a wide range of options during this time such as:
  • Working from home
  • Short term working – reduced hours or pay
  • 3 months pay at 80% from the government – period of Furlough.
  • Lay employees off
  • Asking employees to take annual leave
  • Asking employees to take unpaid leave
Each decision for any business is not one come to lightly and businesses aren’t necessarily aware of the right decision for employees. During this pandemic, businesses are having to make decisions quickly and effectively, however, the majority of businesses are  not following the correct process (ie. failure to consult), therefore potentially being liable for an Employment Tribunal claim.
